MyKlient

1. Acceptance of Terms

By creating an account, downloading, or using the MyKlient mobile application or any related service (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and the Privacy Policy. If you do not agree, do not use the Service.

2. Account Responsibilities

You must provide accurate, current, and complete information when registering an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify us promptly at getmyklient@gmail.com if you suspect unauthorized access to your account.
You are responsible for the accuracy and lawfulness of any client data, photos, notes, or other content you upload through the Service.
You are responsible for obtaining any consent required from your own clients before storing their personal information in the Service.

3. Acceptable Use

You agree NOT to:

Use the Service for any unlawful purpose or in violation of any local, provincial, federal, or international law.
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the application except as expressly permitted by applicable law.
Resell, sublicense, redistribute, or commercially exploit the Service or any of its content without prior written consent.
Interfere with the Service’s operation, attempt to gain unauthorized access to any account or system, or probe for vulnerabilities outside of an authorized security disclosure.
Use the Service to send spam, harass, or contact your clients in any way that violates anti-spam laws including Canada’s Anti-Spam Legislation (CASL).
Upload content that infringes any third party’s intellectual property, privacy, or publicity rights.

4. Intellectual Property

The MyKlient application, its source code, design, branding, logos, and all related intellectual property are owned by Wojciech Radzikowski. You receive a limited, non-transferable, revocable license to use the Service for your own business operations only. No other rights are granted, expressly or by implication.

You retain ownership of the data and content you upload (your client lists, notes, photos, invoices, etc.). By using the Service you grant us a limited license to store, process, and display that content solely for the purpose of providing the Service to you.

5. Service Availability

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, or any specific level of performance, uptime, or response time. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. Where reasonable we will give advance notice of major changes by email or in-app.

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall Wojciech Radzikowski, the operator of MyKlient, or any contributors be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total cumulative liability for any claim relating to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where such exclusions are not permitted, our liability is limited to the smallest extent permitted by applicable law.

7. Termination

You may terminate your account at any time from inside the application or by emailing getmyklient@gmail.com. We may suspend or terminate your access to the Service if you violate these Terms, if your use of the Service creates a material risk to other users or to the Service itself, or if we are required to do so by law. Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination — including Sections 4, 6, 8, and 9 — will survive.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of those courts.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective date” above and, for material changes, notify you by email or in-app message. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes. If you do not agree, you must stop using the Service.

1. Aceptación de los Términos

Al crear una cuenta, descargar o utilizar la aplicación móvil MyKlient o cualquier servicio relacionado (el «Servicio»), usted acepta quedar obligado por estos Términos del Servicio («Términos») y la Política de Privacidad. Si no está de acuerdo, no utilice el Servicio.

2. Responsabilidades de la Cuenta

Debe proporcionar información precisa, actual y completa al registrar una cuenta.
Es responsable de mantener la confidencialidad de sus credenciales de acceso y de toda actividad que ocurra bajo su cuenta.
Debe notificarnos de inmediato a getmyklient@gmail.com si sospecha acceso no autorizado a su cuenta.
Es responsable de la exactitud y legalidad de cualquier dato de clientes, fotos, notas u otro contenido que cargue a través del Servicio.
Es responsable de obtener el consentimiento de sus propios clientes antes de almacenar su información personal en el Servicio.

3. Uso Aceptable

Usted acepta NO:

Utilizar el Servicio para fines ilícitos o en violación de cualquier ley local, provincial, federal o internacional.
Realizar ingeniería inversa, descompilar, desensamblar o intentar extraer el código fuente de la aplicación, salvo lo expresamente permitido por la ley aplicable.
Revender, sublicenciar, redistribuir o explotar comercialmente el Servicio sin consentimiento previo por escrito.
Interferir con el funcionamiento del Servicio, intentar obtener acceso no autorizado a cualquier cuenta o sistema, o sondear vulnerabilidades fuera de una divulgación de seguridad autorizada.
Utilizar el Servicio para enviar spam, hostigar o contactar a sus clientes de cualquier manera que viole leyes anti-spam, incluida la Legislación Anti-Spam de Canadá (CASL).
Cargar contenido que infrinja los derechos de propiedad intelectual, privacidad o publicidad de terceros.

4. Propiedad Intelectual

La aplicación MyKlient, su código fuente, diseño, marca, logos y toda propiedad intelectual relacionada son propiedad de Wojciech Radzikowski. Usted recibe una licencia limitada, no transferible y revocable para utilizar el Servicio únicamente para sus propias operaciones comerciales. No se conceden otros derechos, explícita o implícitamente.

Usted conserva la propiedad de los datos y el contenido que carga (sus listas de clientes, notas, fotos, facturas, etc.). Al utilizar el Servicio nos otorga una licencia limitada para almacenar, procesar y mostrar ese contenido con el único fin de proporcionarle el Servicio.

5. Disponibilidad del Servicio

El Servicio se proporciona «tal cual» y «según disponibilidad». No garantizamos acceso ininterrumpido, funcionamiento sin errores ni ningún nivel específico de rendimiento, tiempo de actividad o tiempo de respuesta. Podemos modificar, suspender o descontinuar cualquier parte del Servicio en cualquier momento sin previo aviso. Cuando sea razonable, daremos aviso anticipado de cambios importantes por correo electrónico o dentro de la aplicación.

6. Limitación de Responsabilidad

En la medida máxima permitida por la ley, en ningún caso Wojciech Radzikowski, el operador de MyKlient, ni ningún colaborador serán responsables por daños indirectos, incidentales, especiales, consecuentes o punitivos, ni por pérdida de ganancias, ingresos, datos o reputación derivados o relacionados con el uso del Servicio. Nuestra responsabilidad acumulada total por cualquier reclamo relacionado con el Servicio no excederá el mayor de: (a) el monto que usted nos pagó por el Servicio en los doce meses anteriores al evento que originó el reclamo, o (b) cien dólares canadienses (CAD $100).

Algunas jurisdicciones no permiten la exclusión o limitación de ciertos daños. Cuando dichas exclusiones no estén permitidas, nuestra responsabilidad se limita al mínimo permitido por la ley aplicable.

7. Terminación

Puede cancelar su cuenta en cualquier momento desde la aplicación o enviando un correo a getmyklient@gmail.com. Podemos suspender o cancelar su acceso al Servicio si infringe estos Términos, si su uso del Servicio crea un riesgo material para otros usuarios o para el Servicio mismo, o si la ley nos obliga a hacerlo. Tras la cancelación, su derecho a utilizar el Servicio finaliza de inmediato. Las disposiciones que por su naturaleza deban sobrevivir a la cancelación — incluidas las Secciones 4, 6, 8 y 9 — sobrevivirán.

8. Ley Aplicable y Resolución de Disputas

Estos Términos se rigen por las leyes de la Provincia de Ontario y las leyes federales de Canadá aplicables en Ontario, sin tener en cuenta los principios de conflicto de leyes. Usted acepta que cualquier disputa derivada o relacionada con estos Términos o con el Servicio se resolverá en los tribunales ubicados en Ontario, Canadá, y consiente la jurisdicción personal de dichos tribunales.

9. Cambios en estos Términos

Podemos actualizar estos Términos periódicamente. Cuando lo hagamos, actualizaremos la «Fecha de vigencia» arriba y, para cambios importantes, le notificaremos por correo electrónico o mediante un mensaje dentro de la aplicación. Su uso continuado del Servicio después de la fecha de vigencia de los Términos actualizados constituye aceptación de los cambios. Si no está de acuerdo, debe dejar de utilizar el Servicio.
